1. Acceptance of Terms

These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Jamam Studio ("Company," "we," "us," or "our") governing your use of any mobile application, software product, website, or related service published or operated by Jamam Studio (collectively, the "Apps" or "Services").

By downloading, installing, accessing, or using any of our Apps, you affirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms in their entirety, you must not download, install, or use our Apps.

If you are accepting these Terms on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms, in which case "you" refers to that entity.

You must be at least 13 years of age (or the minimum digital age of consent in your jurisdiction, if higher) to use our Apps. By using our Apps, you represent that you meet this age requirement. If you are under the applicable age of consent, you may only use our Apps with the involvement and consent of a parent or legal guardian who agrees to these Terms on your behalf.

2. License to Use

Subject to your ongoing compliance with these Terms, Jamam Studio grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use one copy of the App on a mobile device that you own or control, solely for your personal, non-commercial purposes.

2.1 Scope of License

This license permits you to:

• Download and install the App on a compatible device registered to your personal account.
• Use the App for personal, non-commercial, lawful purposes only.
• Access any updates or upgrades to the App that we may make available, subject to these Terms.

2.2 License Limitations

This license does not include any right to: (a) use the App for commercial purposes or on behalf of any third party; (b) transfer the App or this license to any other person; (c) use the App in any manner that violates applicable law, regulation, or these Terms; or (d) use the App in a way that infringes the intellectual property or other rights of Jamam Studio or any third party.

2.3 Updates

Jamam Studio may, at its sole discretion, release updates, patches, bug fixes, or new versions of the App from time to time. Such updates may be automatic or may require your manual action within the Google Play Store or other applicable distribution platform. Continued use of the App after an update constitutes your acceptance of the updated software. We recommend keeping the App updated to the latest version to ensure optimal performance and security.

3. Restrictions

The license granted in Section 2 is conditioned upon your compliance with all of the following restrictions. You agree that you will not, and will not permit, assist, or encourage any third party to:

• Reverse Engineer: Decompile, disassemble, decrypt, reverse engineer, or otherwise attempt to derive the source code, underlying algorithms, or architecture of the App or any part thereof, except to the limited extent that applicable law expressly permits such activity notwithstanding this restriction.
• Modify or Create Derivative Works: Modify, adapt, translate, or create derivative works based upon the App, its content, or any portion thereof.
• Redistribute or Sublicense: Copy, reproduce, distribute, publish, sell, resell, transfer, assign, sublicense, or otherwise make the App available to any third party, whether for commercial gain or otherwise.
• Remove Proprietary Notices: Remove, alter, or obscure any copyright notice, trademark, watermark, attribution, or other proprietary rights notice contained in or displayed by the App.
• Use for Unlawful Purposes: Use the App for any illegal, fraudulent, harmful, or unauthorized purpose, including but not limited to violating any applicable local, national, or international law or regulation.
• Circumvent Security Measures: Attempt to bypass, disable, or circumvent any technological protection measure, digital rights management system, or security feature of the App or any related infrastructure.
• Introduce Malware: Upload, transmit, or introduce any viruses, Trojan horses, worms, spyware, adware, or any other malicious or harmful code or program through or in connection with the App.
• Interfere with Services: Interfere with, disrupt, or place an unreasonable burden on the servers, networks, or infrastructure associated with the App, including through automated scraping, crawling, denial-of-service attacks, or similar techniques.
• Unauthorized Data Collection: Collect or harvest any personally identifiable information from other users of the App without their express consent.
• Impersonate: Impersonate Jamam Studio, any of its employees or representatives, or any other person or entity in connection with your use of the App.

Any violation of these restrictions may result in immediate termination of your license and may expose you to civil and/or criminal liability.

4. Intellectual Property

The App and all content, features, and functionality contained therein — including but not limited to all software code, text, graphics, logos, icons, images, audio clips, user interfaces, and the selection, coordination, and arrangement thereof — are the exclusive property of Jamam Studio or its licensors and are protected by applicable intellectual property laws, including copyright, trademark, trade secret, and patent laws of applicable jurisdictions.

4.1 Ownership

These Terms do not transfer to you any right, title, or interest in or to the App or any related intellectual property. All rights not expressly granted in these Terms are reserved by Jamam Studio. No license, right, or interest in any Jamam Studio trademark, service mark, or trade name is granted under these Terms.

4.2 Feedback

If you choose to submit to Jamam Studio any ideas, suggestions, feature requests, comments, or other feedback relating to the App ("Feedback"), you hereby grant Jamam Studio a perpetual, irrevocable, royalty-free, worldwide, fully sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such Feedback for any purpose, without any obligation of confidentiality, attribution, or compensation to you.

4.3 Third-Party Content

Certain features of our Apps may permit you to interact with, access, or display content from third-party websites, platforms, or sources. Jamam Studio does not claim ownership of any third-party content accessed through the App. You are solely responsible for ensuring that your use of any third-party content complies with applicable intellectual property laws and the terms of service of the relevant third-party platform.

5. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE APPS AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

Jamam Studio expressly disclaims all warranties, including but not limited to:

• Implied Warranties: Any implied warranty of merchantability, fitness for a particular purpose, title, quiet enjoyment, or non-infringement.
• Accuracy and Reliability: Any warranty that the App will be accurate, reliable, error-free, uninterrupted, or virus-free.
• Availability: Any warranty that the App will be available at any particular time or location, or that defects or errors will be corrected.
• Fitness: Any warranty that the App will meet your specific requirements or expectations.
• Security: Any warranty that information transmitted to or from the App will be secure or that unauthorized access to the App or its servers will not occur.

Some jurisdictions do not allow the exclusion of implied warranties or limitations on applicable statutory rights of a consumer, so some or all of the above exclusions may not apply to you. In such cases, the exclusion or limitation shall apply to the maximum extent permitted by applicable law.

You acknowledge that your use of the App is at your sole risk, and that you are solely responsible for any damage to your device, loss of data, or other harm that results from your use of the App.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL JAMAM STUDIO, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, SUPPLIERS, OR LICENSORS BE LIABLE TO YOU FOR ANY:

• Indirect, incidental, special, consequential, punitive, or exemplary damages;
• Loss of profits, revenue, data, goodwill, or business opportunities;
• Costs of procurement of substitute goods or services;
• Personal injury or property damage arising out of or related to your use of the App;
• Unauthorized access to or alteration of your data or transmissions;
• Conduct of any third party in connection with the App;

whether based on warranty, contract, tort (including negligence), strict liability, or any other legal theory, and whether or not Jamam Studio has been advised of the possibility of such damages.

AGGREGATE LIABILITY CAP: To the maximum extent permitted by applicable law, Jamam Studio's total cumulative liability to you for all claims arising out of or relating to these Terms or your use of the Apps, regardless of the form of action, shall not exceed the greater of: (a) the total amount paid by you to Jamam Studio in the twelve (12) months immediately preceding the event giving rise to the claim; or (b) USD $10.00 (ten United States dollars).

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitations may not apply to you in whole or in part. In such jurisdictions, liability is limited to the fullest extent permitted by applicable law.

The limitations of liability in this Section reflect a reasonable allocation of risk between you and Jamam Studio and are a fundamental element of the basis of the bargain between the parties. Jamam Studio would not be able to provide the Apps without such limitations.

7. Indemnification

You agree to indemnify, defend, and hold harmless Jamam Studio and its directors, officers, employees, contractors, agents, licensors, suppliers, and successors from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

• Your access to or use of the App;
• Any content you submit, post, or transmit through or in connection with the App;
• Your violation of these Terms;
• Your violation of any applicable law or regulation;
• Your violation of any third-party rights, including any intellectual property rights or privacy rights;
• Any claim that your use of the App caused damage to a third party.

Jamam Studio reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of these claims. You agree not to settle any such matter without the prior written consent of Jamam Studio.

8. Third-Party Services

Our Apps may integrate with or depend upon certain third-party services, platforms, and tools. Your use of these third-party services is governed by the respective terms and policies of those services, not by these Terms. We encourage you to review those terms carefully.

8.1 Google Play Store

Our Apps are distributed through the Google Play Store. By downloading our Apps from the Google Play Store, you acknowledge that you are also subject to Google's Terms of Service and Google Play Store Terms of Service, available at play.google.com/intl/en_us/about/play-terms/. In the event of a conflict between these Terms and the Google Play Terms of Service with respect to your use of our Apps, the Google Play Terms of Service shall govern solely with respect to matters expressly addressed therein.

8.2 Google AdMob (Advertising)

Certain Apps are supported by advertising served by Google AdMob. AdMob may use device identifiers and other data to deliver interest-based advertising. By using our free, ad-supported Apps, you consent to the delivery of such advertisements. The collection and use of data by Google AdMob is governed by Google's Privacy Policy, available at policies.google.com/privacy, and Google's Advertising Policies. You may opt out of interest-based advertising by adjusting your device settings (e.g., enabling "Opt out of Ads Personalization" in your Android device settings).

8.3 In-App Purchases & Billing

Any in-app purchases made through our Apps are processed by the relevant app store platform (e.g., Google Play Billing). Jamam Studio does not independently process or store your payment card information. All billing disputes should be directed to your app store platform in the first instance. Refund eligibility is determined by the applicable app store platform's refund policy.

8.4 No Endorsement

The inclusion of a link to, or integration with, a third-party service does not imply Jamam Studio's endorsement, approval, or sponsorship of that service or its content. Jamam Studio is not responsible for the content, privacy practices, or terms of any third-party services.

9. Changes to Terms

Jamam Studio reserves the right to modify, update, or replace these Terms at any time at its sole discretion. When we make material changes, we will indicate the revised date at the top of this page and, where required by applicable law or where we consider it appropriate, provide more prominent notice (such as an in-app notification or email, if we hold your contact information).

Your continued use of any App after the effective date of the revised Terms constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the App and uninstall it from your device.

We recommend that you review these Terms periodically to stay informed of any changes. The most current version of these Terms will always be available at www.jamamstudio.com/terms.html.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which you are ordinarily resident ("your local jurisdiction"), without regard to its conflict of law provisions. This choice of law does not limit any consumer protection rights you may have under the mandatory laws of your jurisdiction.

10.1 Dispute Resolution

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Apps ("Dispute"), the parties agree to first attempt to resolve the Dispute informally by contacting Jamam Studio at contact@jamamstudio.com. We will use commercially reasonable efforts to resolve the Dispute within thirty (30) days of receipt of your notice.

If informal resolution is not achieved, the Dispute shall be submitted to the competent courts of your local jurisdiction, and you and Jamam Studio hereby irrevocably consent to the personal jurisdiction of such courts. Nothing in this clause shall limit your rights under any mandatory consumer protection laws of your local jurisdiction.

10.2 Class Action Waiver

To the fullest extent permitted by applicable law, you and Jamam Studio agree that any proceedings to resolve or litigate any Dispute, whether in arbitration, small claims court, or otherwise, shall be conducted solely on an individual basis. Neither you nor Jamam Studio shall seek to have any Dispute heard as a class action, representative action, collective action, or private attorney general action.

10.3 Time Limitation on Claims

Any claim arising out of or relating to these Terms or your use of the Apps must be commenced within one (1) year after the cause of action accrues; otherwise, such cause of action is permanently barred. This limitation does not apply where prohibited by applicable mandatory law.
